TERMS AND CONDITIONS OF SERVICE

This page (together with the documents referred to on it) tells you the terms and conditions on which we supply our products and services. Please read these terms and conditions carefully before ordering any products from our site or engaging with our service. By accessing our site and placing an order from us, you have agreed to be bound by these terms and conditions and our term of use policy.

  1. INFORMATION ABOUT US
    • comis a website operated by Souldeliciouz Limited (“we” or “us” or “Souldeliciouz”), incorporated and registered in England, United Kingdom, whose registered office is at 86-90 Paul Street, London United Kingdom. Our Company registration number is 08152122. Souldeliciouz is a business which prepares and sells food, condiments (cooking sauces and cooking spices) and Qoolpicks flavoured toothpicks. We make and deliver food within delivery areas and delivery arrangements.
  2. PURPOSE
    • The purpose of our service is to provide simple and convenient service to you; tasty and delicious Afro/Caribbean Soul food.
  3. SERVICE AVAILABILITY

3.1. Souldeliciouz offers a delivery service for lunchtime in the London city. If you live outside the delivery areas, we will email you upon receipt of your order and arrange a refund. We also provide buffet style bespoke services for weddings, birthday parties, and office caterings as directed by our clients within working arrangements/agreements (contractual agreements).

4     ORDERS

4.1 When you place an order through our Service, an email thanking you for your order and confirming your order will be received and accepted (the “Confirmation Email”) and will be emailed to you. The contract will be between you and Souldeliciouz Limited and will only be formed when you have been presented with the Confirmation Email. We may reverse this if in case the orders have time constraints, or you are located outside our service area. Please ensure that you have given us a correct email address as this is how we will communicate with you about your order. Please also ensure that you provide an accurate address and telephone number. Souldeliciouz seeks to provide quality service. It is of utmost importance to us that we comply with high standards and maintain our reputation. Please let us know if you have any comments relating to our services by emailing or calling us.

4.2 All orders are subject to availability. We may offer an alternative for any meal we cannot provide you with. We may use nuts in the preparation of certain meals and our kitchen is not ‘nut free’. Please call us prior to ordering if you have an allergy. We cannot guarantee that any of the meals we sell are free of allergens.

5   AVAILABILITY AND DELIVERY

5.1 Our aim is to provide the best service possible. Delivery of service will be based on contractual agreements. Unfortunately, things do not always go to plan and factors, such as traffic conditions and weather, may occasionally prevent us from achieving our targets in this regard. We will do our best to ensure that your meal is delivered by the time specified in the email. The timing of your order is determined by taking into account the number of orders and the circumstances being faced at that time.

5.2 Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation. It is the customer’s responsibility to make sure someone is available to receive their food order on specified delivery date.
5.3 Delivery dates/windows stated by Souldeliciouz are an indication and not a guarantee of delivery within these days/hours.

5.4 Delivery will be completed when we, or our authorised courier company, deliver the Products to the address you gave us. If no one is available at your address to take delivery, we, or our authorised courier company, will follow the delivery instructions provided to us by you. If no leave safe instructions are specified, the order will be left in an area that the authorised courier company considers safe.

5.5 The leave safe location specified by you shall be within the area of the delivery address and shall be accessible to the courier. We will endeavour to follow any delivery instructions you provide but this cannot be guaranteed.

5.6 Souldeliciouz will not attempt a further delivery. You are obliged to bear all expenses related to aforesaid default of acceptance.

6   CHANGES/CANCELLATION

6.1 Changes to an Event Catering order can be made given enough notice (see 6.2). Any changes to decrease the amount of people in an order must be done 48 hours before pick up/delivery for orders below 50. Orders over 50 people must be 72 hours’ notice given. Last minute changes over 5 people increase to order will incur a charge of 30.00GBP. This applies to all hot food, Lunch/Buffet/Canapés orders.

6.2 You have the right to cancel an order within a reasonable time and before we have started putting the order together. We will not be able to cancel orders when deposits have been paid. However, agreements could be reached on future order.  We may cancel any order and will tell you once we cancel an order if deposit has not been paid. You will not be charged for any orders cancelled in accordance with this clause if ample time has been given and we have not started preparing for an order.  Any payment made prior to an order being cancelled by us will be reimbursed. Any order cancelled after we have started preparing it will be charged to you.

6.3 Any online food ordering such as Weekender/Lunch/Buffet/Canapés cannot be cancelled once preparation has started. For instance, a customer places an order in the morning for delivery of chosen date, they can cancel by end of same day of order. Once preparations have started on the order customer cannot request refund and the bill will be chargeable

6.4 COVID-19 DISRUPTION- Any cancellations in relation to the current global pandemic, due to more lockdowns/restrictions imposed by the government that impacts large gatherings taking place, you will be entitled to a full refund. Other cancellations rules apply in our terms and conditions for any other reason.

 

7   PRICE AND PAYMENT

7.1 The price of any meal option will be listed on our website. Prices will vary between menus (Soul food boxes/Buffet/Canapés/Weekender). Prices are liable to change at any time, but changes will not affect orders in respect of which you have been presented with the Confirmation Email, save in the case of an obvious pricing mistake, whereby we will notify you as soon as we can about the pricing issue. You may be able to cancel your order once we notify you. Payment for all orders placed on our website can be made via BACS Transfer or PayPal using credit or debit card and bank transfer from invoice.

8   OUR LIABILITY

8.1 We make no representation or warranty of any kind, express or implied, regarding the content or availability of our Service, or that it will be timely or error-free, that defects will be corrected. We shall not have any liability to you for any direct, indirect, special, or consequential losses or damages arising in contract, tort (including negligence) or otherwise arising from your use of or your inability to use our Service. If we are found to be liable to you, our total aggregate liability is limited to the purchase price of the meals you have paid for in your order. This does not include or limit in any way our liability for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.

9    EVENTS OUTSIDE OUR CONTROL

9.1 No party shall be liable to the other for any delay or non-performance of its obligations under this Agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion, or civil commotion. For the avoidance of doubt, nothing not included in clause 9:1 shall excuse the Customer from any payment obligations under this Agreement.

10   WAIVERS

10.1 Neither you, nor Souldeliciouz shall be responsible to the others for any delay or non-performance of its obligations under this agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion, or civil commotion.

      11 SEVERABILITY

11.1 If any provision of this agreement is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions shall not be prejudiced.

12 CLEANING OF EQUIPMENTS

12.1 Souldeliciouz are not responsible for cleaning of any equipment used in delivering or serving Buffet Food unless these services are purchased additionally with food order.

12.2 Third Party Delivery Services we use such as Deliveroo, City Pantry and Caterwings etc, will be liable for any charges incurred to clean equipment such as food warmers, serving spoons, plates and cutleries, Hot boxes and Thermo Bags used by their delivery drivers or customers.

       13 ENTIRE AGREEMENTS

13.1 This Agreement and the documents annexed as appendices to this agreement or otherwise referred to in it contain the whole agreement between the parties relating to the subject matter of it and supersede all prior agreements, arrangements and understandings between the parties relating to that subject matter.

       14 OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

14.1 Souldeliciouz may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you.

      15 LAW AND JURISDICTION

15.1 The English courts will have jurisdiction over any claim arising from, or related to, a visit to our Service or use of our Services. These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United Kingdom

Email marketing messages & subscription

Under the GDPR we use the consent lawful basis for anyone subscribing to our newsletter or marketing mailing list. We only collect certain data about you, as detailed in the “Processing of your personal date” above. Any email marketing messages we send are done so through an EMS, email marketing service provider. An EMS is a third-party service provider of software / applications that allow marketers to send out email marketing campaigns to a list of users.

Email marketing messages that we send may contain tracking beacons / tracked clickable links or similar server technologies to track subscriber activity within email marketing messages. Where used, such marketing messages may record a range of data such as times, dates, I.P addresses, opens, clicks, forwards, geographic and demographic data. Such data, within its limitations will show the activity each subscriber made for that email campaign.

Any email marketing messages we send are in accordance with the GDPR and the PECR. We provide you with an easy method to withdraw your consent (unsubscribe) or manage your preferences / the information we hold about you at any time.
